Agreement to these Terms

These Terms of Use govern your access to and use of azyckcyberinsurance.com and related online services operated by Azyck. By using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

Eligibility and accounts

You must be legally capable of entering a binding agreement and use the Services only for lawful purposes. You are responsible for maintaining accurate account information, safeguarding your credentials, restricting access to your account, and promptly notifying Azyck of any suspected unauthorized use. Azyck may require additional verification.

Insurance inquiries, applications, and coverage

The Services may allow you to request information, assessments, appointments, indications, quotes, applications, or access to insurance-related resources. These activities do not guarantee eligibility, pricing, availability, placement, issuance, renewal, or payment of a claim and do not bind coverage. You must review the final application and policy documents and promptly correct inaccurate or incomplete information.

Coverage may be bound only as described in the Legal Notice and Cyber Liability Disclosure. If you need to report a claim or cyber incident, follow the reporting instructions in the applicable policy. A website message, booking, or general email does not satisfy a policy notice requirement unless the policy or an authorized representative expressly says it does.

Permitted and prohibited use

You may use the Services for legitimate personal or internal business purposes. You may not:

  • Violate law, regulation, sanctions, another person's rights, or an applicable contract.
  • Misrepresent identity, authority, business information, risk information, incidents, or material application facts.
  • Attempt to gain unauthorized access, probe or bypass security, introduce malware, overload systems, interfere with operation, or help another person do so.
  • Scrape, harvest, crawl, index, copy, or use automated means to access content or personal information except as expressly permitted in writing or by standard search-engine instructions.
  • Use the Services to develop a competing database or product, train an AI model without permission, infringe intellectual property, transmit unlawful content, or send spam.
  • Reverse engineer, decompile, remove notices, or circumvent usage restrictions except where law prohibits the restriction.

User submissions

You retain ownership of information you submit. You grant Azyck a limited right to host, process, reproduce, transmit, and use that information as reasonably necessary to provide the requested Services, comply with law, protect security, and exercise rights under these Terms and the Privacy Policy. You represent that you have the right to submit the information and that it is accurate and lawful.

Electronic communications

You consent to receive electronic records and service communications where permitted by law. Marketing calls, texts, and emails are subject to separate consent and opt-out requirements. Marketing consent is not a condition of purchasing insurance unless lawfully and clearly stated otherwise. Keep contact information current.

Intellectual property

The Services and their content are owned by or licensed to Azyck. These Terms grant only a limited, revocable, nonexclusive, nontransferable right to use the Services as permitted. No ownership right is transferred. Azyck may use feedback without restriction or compensation, provided it does not disclose confidential information Azyck has agreed to protect.

Third-party services

The Services may link to or depend on third-party platforms, carriers, brokers, underwriting systems, appointment tools, payment providers, security tools, or content. Third-party terms and privacy notices may apply. Azyck is not responsible for third-party services except to the extent required by law or an express written agreement.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." AZYCK DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. AZYCK DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR SUITABLE FOR A PARTICULAR INSURANCE, CYBERSECURITY, OR COMPLIANCE NEED. THESE DISCLAIMERS DO NOT LIMIT RIGHTS THAT CANNOT LAWFULLY BE WAIVED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZYCK AND ITS OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM THE SERVICES. Nothing here limits liability that cannot lawfully be limited, or obligations under an issued insurance policy.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Azyck harmless from third-party claims arising from your unlawful use of the Services, violation of these Terms, infringement of another person's rights, or information you submit.

Suspension and termination

Azyck may suspend or terminate access when reasonably necessary to protect the Services or others, investigate suspected misuse, comply with law, or enforce these Terms. Provisions that by their nature should survive will survive termination.

Governing law; disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where another law must apply.

Changes, severability, and contact

Azyck may revise these Terms by posting an updated version and changing the Last Updated date. Material changes will be communicated as required by law. If a provision is unenforceable, it will be modified or severed to the minimum extent necessary, and the remaining provisions will continue.
